1. Deposit (60%) must be made one day before commencement of work, unless otherwise stipulated on the invoice. Second payment (30%) on completion of shell/ delivery of shell from factory. Final payment (10%) on completion of pool.

2. Pump system and pool cleaner as per manufactures/ suppliers guarantee.

3. Should the Client not make the required payments on delivery of the pool equipment as stipulated in the contract, Miracle Pools shall stop immediately, the Client will then have 7 days to make the necessary payment. Should the Client not pay the said monies in full as per the contract Miracle Pools shall have full rights to remove the pool equipment from the site and the Purchaser shall be held responsible for all costs incurred by Miracle Pools up to the said date.

4. The contract allows for the normal offloading of the pool. In the event of the installation site being in such a nature or in such a position that a crane is required, the Client undertakes to be liable for the payment to Miracle Pools of any additional hire or charges negotiated. (Only applicable on Fiberglass Pools)

5. The Client is responsible for any costs in excess of R1 500 for the electrical connection.

6. The contract price is based upon the understanding by Miracle Pools that the excavation and other work can occur on the installation site by means normal soft digging and without special problems or delays and that the installation site shall be accessible without particular difficulty. In the event that this may not be the case and/or in the event of delays and/or the necessity for particular steps to be taken because of stone rock or any other object in the soil or nature of the soil, or because of the moving of pipe work, cables or any other obstruction or because of de-watering of the excavation, the Client shall be liable for the payment to Miracle Pools of all such additional costs as determined by Miracle Pools as have been incurred in consequence thereof. (Compressor/Jack Hammer charges will be negotiated where necessary.)

7. The Purchaser herby indemnifies Miracle Pools, its Agents and servants from any liability for any damage whatsoever which may be caused during the presence of Miracle Pools on the property and during the course of his activities in connection with this agreement. Miracle Pools will however work with great care not to damage anything on the Property.

8. While Miracle Pools shall make any reasonable effort to commence the supply and installation of the pool on the commencement date requested in and to complete such work as soon as possible, no firm undertaking can be given by Miracle Pools in this regard and such requested date is not a condition of this agreement.

9. On completion of the installation work in terms hereof the contractor shall deliver a Certificate of Completion (Final invoice) to the Client and unless the Client immediately disputes such completion the said certificate shall be proof of proper completion. The use of the pool shall be deemed to be acceptance of proper completion.

10. It is acknowledged by the Client that this agreement is neither a quotation nor an order but a binding agreement which as form signature thereof by him shall be completely effective unless Miracle Pools, at its entire discretion, shall have within 30(thirty) days thereof by written notice to the Client elected to reconcile from and cancel this agreement. In such event the only obligation which Miracle Pools then shall have is to refund the Purchaser, without interest, all monies thus far paid to him by the Client. 

11. Ownership in all equipment and or materials delivered to and or used on the worksite remains vested in Miracle Pools until the full contract price due in terms of this contract has been paid in full. The owner specifically agrees to give Miracle Pools access to the work site to remove his equipment, materials and or pool shell fiberglass pool (if applicable) in terms of this clause.

12. Payment for additional work is to be made in advance of additional work unless cost is unknown. If cost is unknowns, payment must be made immediately on completion of additional work.

13. The Client shall at all times ensure that the works are not hindered or interfered with by anyone, whomsoever or anything whatsoever and in particular, shall be liable to keep away from the works and all aspects thereof at all times any animals as well as persons other than those engaged by Miracle Pools for the works.

14. Cancellation of Agreement by the Client without written approval of Miracle Pools, a fee of 5% of the contract price will be imposed to cover commissions and administration costs

15. All Natural Causes out of Miracle Pools control cannot be covered by Miracle Pools.

16. Should any additional costs occur the Client will be liable for such.

17. Any accident and/or incidents out of Miracle Pools control cannot be covered by guarantee.

18. The backwash pipe will be discharged maximum 1m from the pool pump, the Client shall reimburse Miracle Pools for any additional costs for additional plumbing.

19. Should any other party work on/ at the structure/ plumbing of the pool, no liability will be taken by Miracle Pools.

20. Should any other parties on site use any of Miracle Pools equipment, the Client shall reimburse Miracle pools should equipment go missing. Miracle Pools take no responsibility for any injuries incurred while using equipment.
