Payment Terms

A deposit of 60% must be made one day before the commencement of work, unless otherwise stipulated on the invoice. The second payment of 30% is due upon completion or delivery of the shell from the factory. The final payment of 10% is due upon completion of the pool.

The pump system and pool cleaner are subject to the manufacturer’s or supplier’s guarantee.
Non-Payment Clause

If the Client fails to make the required payments as stipulated, Miracle Pools shall halt work immediately. The Client will have 7 days to make the necessary payment. Failure to pay in full as per the contract will entitle Miracle Pools to remove the pool equipment from the site, and the Client will be responsible for all costs incurred up to that date.
Delivery and Installation Conditions

The contract includes the standard offloading of the pool. If the installation site requires a crane, the Client is responsible for any additional hire charges. (Applicable to Fiberglass Pools only.)

The Client is responsible for any electrical connection costs exceeding R1,500.

The contract price assumes that excavation and related work can proceed normally. If there are delays or special conditions such as rock, obstructions, or de-watering, the Client will bear any additional costs incurred.
Liability and Indemnity

The Client indemnifies Miracle Pools, its agents, and servants from any liability for damage caused during the presence and activities of Miracle Pools on the property. Miracle Pools will exercise great care to avoid damage.
Work Schedule

While Miracle Pools will endeavor to start and complete the work as soon as possible, no firm dates can be guaranteed.
Completion and Acceptance

Upon completion, Miracle Pools will provide a Certificate of Completion (Final Invoice). Unless immediately disputed, this certificate shall be deemed proof of proper completion. Use of the pool signifies acceptance of completion.
Contract Terms

This agreement is binding upon signature by the Client. Miracle Pools reserves the right to cancel the agreement within 30 days, refunding any payments made without interest.
Ownership and Access

Ownership of all equipment and materials remains with Miracle Pools until full payment is received. The Client agrees to provide access for the removal of equipment and materials if necessary.
Additional Work

Payment for additional work must be made in advance unless the cost is unknown, in which case payment is due immediately upon completion.

Repairs under warranty

If repairs are warranted under the terms of our warranty, it is important to note that any costs associated with refilling the pool water will not be covered by MiraclePools. This includes the expenses for the water itself, any necessary chemicals, and any labor involved in the refilling process.
Site Conditions

The Client must ensure that the work is not hindered by any persons, animals, or other obstacles.
Cancellation Policy

If the Client cancels the agreement without written approval from Miracle Pools, a fee of 5% of the contract price will be imposed.
Force Majeure
-
Miracle Pools is not liable for natural causes or events beyond its control.
Miscellaneous Costs

The Client will be responsible for any additional costs that arise.
Liability Limitations
-
Miracle Pools is not liable for accidents or incidents beyond its control.
Plumbing
-
The backwash pipe will be discharged a maximum of 1m from the pool pump. The Client will reimburse Miracle Pools for any additional plumbing costs.
Third-Party Work
-
Miracle Pools will not be liable for any work done on the pool by third parties.

The Client is responsible for reimbursing Miracle Pools for any missing equipment or injuries incurred from unauthorised use of Miracle Pools' equipment.
